AI replies can be wrong. Contained Evolution uses AI models to generate responses, summaries, and personalized content. AI output is not professional advice — not medical, legal, financial, or therapeutic. Verify anything important before relying on it. These Terms govern your use of the platform including all paid subscription plans.

1. Acceptance & Eligibility

By clicking "Agree," creating an account, or using any part of the Contained Evolution platform ("CE," "the app," "the service"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms") and any policies incorporated by reference.

Age requirement. You must be at least 18 years old. CE is not directed at children under 13, and we do not knowingly collect data from them. If you are between 13 and 17, you must have verifiable parental consent before using the service.
Legal capacity. You must have the legal capacity to enter a binding contract in your jurisdiction.
Individual accounts. Each account is for one person. Sharing login credentials is not permitted.
Business users. If you use CE on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. Account Registration & Security

You create an account by providing an email address and password. You are responsible for all activity that occurs under your account.

Provide accurate, current information. Do not impersonate anyone.
Keep your password confidential. CE will never ask for your password via email or chat.
Notify us immediately at containedevolution@gmail.com if you suspect unauthorized access.
CE is not liable for losses resulting from unauthorized use of your account if you failed to keep your credentials secure.
We may require identity verification before restoring access to a locked account.

3. Paid Subscriptions & Billing

CE offers free access and one paid subscription plan: PASS ($5/month). Subscriptions are processed through Stripe.

Auto-renewal disclosure (required by law): Your subscription automatically renews at the end of each billing period (monthly) at the then-current price until you cancel. You will be charged to the payment method on file. By subscribing, you authorize this recurring charge.

Pricing. PASS is $5/month, displayed on the upgrade page within the app, and may change with notice. We will notify you at least 30 days before any price increase affecting your existing subscription.
Free tier. The free plan provides a capped amount of CE-funded AI usage (the "free floor") plus baseline storage, at no charge. CE reserves the right to adjust free-tier limits.
PASS. PASS includes a monthly Stardust allotment and access to more capable AI models. Stardust is CE's in-app unit for AI usage: 1,000 Stardust equals $1 of AI usage. Your allotment is added each billing cycle and funds AI usage beyond the free floor. Stardust is non-transferable, has no cash value, and cannot be redeemed for money. Additional PASS features may be introduced over time.
Cancellation. You may cancel your subscription at any time through Stripe (via the billing link in the app). Cancellation takes effect at the end of the current billing period; you retain PASS access through that date. No partial-period refunds are issued after the billing date.
Refunds. Refund requests within 7 days of initial subscription or renewal may be considered at CE's discretion. Contact containedevolution@gmail.com.
Failed payments. If a payment fails, we will retry and notify you. After repeated failures, your subscription may be downgraded to the free tier.
Taxes. Prices shown may exclude applicable sales tax. You are responsible for any taxes applicable to your subscription in your jurisdiction.

4. AI-Powered Features & Limitations

CE uses large language models (LLMs) to power features including (but not limited to): the Personal Assistant (PA), Daily Brief, Notes, Brainstorm, Scope, and automated background tasks. By using these features you acknowledge:

AI output is not guaranteed to be accurate, complete, or current. Language models can produce incorrect, outdated, or fabricated information ("hallucinations"). Always verify important information through authoritative sources.
Not professional advice. No content generated by CE constitutes medical, legal, financial, psychological, therapeutic, or other professional advice. Do not substitute AI output for consultation with a qualified professional.
No emergency services. CE is not a crisis service and cannot contact emergency services on your behalf. If you are in immediate danger, contact local emergency services (911 in the USA).
AI inferences about you. CE's Memory Bank and personalization features may cause the AI to infer information about your health, emotions, habits, beliefs, or preferences from your conversations and journal entries. These inferences are stored to personalize your experience and may be inaccurate. You have the right to review and delete them (see Section 6 and Section 10).
Personality and behavior. The PA's personality is configured by you during onboarding and is not a representation of a real person. Responses reflect statistical patterns in training data, not genuine understanding or intent.

5. AI Model Providers & Data Processing

CE routes AI requests through the following third-party model providers. Your conversation content (prompts and context) is transmitted to these providers to generate responses:

Anthropic, PBC — Claude models (claude.ai). Anthropic's API usage policy applies. As of September 2025, Anthropic retains API inputs/outputs for up to 7 days for safety purposes and does not use them to train future models by default.
Google LLC — Gemini models. Google's API Terms of Service and Generative AI usage policies apply.
OpenRouter Inc. — A routing layer providing access to various third-party models. OpenRouter's Terms of Service and the terms of the underlying model provider apply.

The specific model used for your request depends on your plan: free usage runs on a standard, cost-efficient model, while PASS usage runs on more capable models funded by your Stardust balance. You do not choose a specific provider or model per message. CE does not control these providers' data practices. You are encouraged to review each provider's privacy policy and terms of service.

CE does not sell your conversation data to advertisers or data brokers. Your data is processed by CE and the above providers solely to operate the service.

6. Memory Bank & Persistent Personalization

CE's Memory Bank stores facts, preferences, and inferences about you to provide a personalized experience across sessions. This is a core feature of the platform. By using CE you consent to this personalization system operating as described below.

What is stored. The AI may extract and store facts from your conversations, journal entries, brainstorming sessions, and other inputs — including preferences, goals, habits, health notes, relationships, and personality observations.
How it is used. Stored memories are injected into future AI context to make responses more relevant and personal to you.
Sensitive inferences. Some inferred facts may relate to health, emotions, or beliefs. Under GDPR Article 9, processing of health-related data requires explicit consent. By enabling and using Memory Bank, you provide that consent. You may withdraw consent by deleting individual memories or clearing your Memory Bank.
Your controls. You can view all stored memories in the Memory Bank app, edit individual facts, or delete any or all memories at any time. Deleting a memory removes it from future AI context; it may remain in database backups for up to 30 days.
Companion soul. Your Companion has a "soul" — a persistent identity and personality profile established when you adopt it. In the Companion Hub you can view its soul, rename the Companion, and select bounded personality traits. Those deliberate edits are stored in your account and do not remove the service's safety boundaries.
Memory Archive. Older memories may be archived. Archived memories are not actively injected into AI context but remain accessible to you in the app and can be restored or deleted.

7. Bring Your Own Key (BYOK)

Brain Power settings allow you to provide your own API keys for third-party AI providers. If you use BYOK:

You are solely responsible for the security of your API key. CE stores your key in encrypted form but cannot guarantee absolute security.
All API usage billed under your key is your financial responsibility, not CE's.
Your use of a BYOK key must comply with the third-party provider's terms of service. CE is not a party to that agreement.
If your key is compromised, revoke it immediately with the provider and update or remove it in CE.
CE uses your key only to fulfill AI requests you initiate. We do not use BYOK keys for any other purpose.

8. User Content & Intellectual Property

Your content is yours. You retain all ownership rights to the content you create in CE — notes, journal entries, drawings, templates, task lists, plans, and other material you author ("User Content").

License to CE. By submitting User Content, you grant CE a limited, non-exclusive, royalty-free license to store, process, display, and transmit your content as necessary to operate the service (including sending it to AI model providers as described in Section 5). This license ends when you delete the content or close your account.
AI-generated content. Content substantially generated by AI at your direction is subject to the intellectual property rules of the applicable AI provider. You are responsible for reviewing those rules if you intend to use AI-generated output commercially.
CE intellectual property. The CE platform, app design, branding, software, and underlying systems are owned by Contained Evolution LLC or its licensors. You may not copy, reverse-engineer, or redistribute them.
Feedback. If you submit feedback, suggestions, or bug reports to CE, you grant CE the right to use them without compensation or attribution.

9. Privacy & Data Collection

This section summarizes how CE handles your data. A full Privacy Policy is a separate document. Key points:

Data we collect: email address, hashed password, subscription status, AI conversation content, journal and note text, Memory Bank entries, usage logs, and device/browser information for session management.
Why we collect it: to operate the service, personalize the AI, process payments, detect abuse, and comply with legal obligations.
How long we keep it: account data is retained while your account is active. After account deletion, personal data is purged within 30 days except where retention is required by law (e.g., billing records retained 7 years for tax purposes).
Third parties we share data with: Stripe (payment processing), Anthropic / Google / OpenRouter (AI model inference — see Section 5), and Railway (cloud infrastructure/hosting). We do not sell your data.
Opt-in grocery sharing: Instacart receives unchecked item names and quantities only when you enable and confirm a Taste Buds shopping-list handoff. We do not sell your data.
Security. CE uses HTTPS, encrypted storage for sensitive fields (API keys, passwords), and JWT-based authentication. No system is perfectly secure; use a strong unique password.
No advertising tracking. CE does not use advertising networks or tracking pixels.

10. GDPR & CCPA User Rights

If you are in the European Economic Area (EEA), United Kingdom, or California, you have additional rights regarding your personal data:

Right of access. Request a copy of the personal data CE holds about you.
Right to rectification. Request correction of inaccurate or incomplete data.
Right to erasure ("right to be forgotten"). Request deletion of your personal data. To delete your account and all associated data, use the Account settings within the app or email containedevolution@gmail.com.
Right to data portability. Request an export of your data in a machine-readable format via the Account settings (Data Export).
Right to restrict processing. Request that CE limit how it uses your data in certain circumstances.
Right to object. Object to processing based on legitimate interests.
Right to withdraw consent. Where processing is based on consent (e.g., Memory Bank sensitive inference), you may withdraw consent at any time by deleting the relevant data. Withdrawal does not affect prior processing.
CCPA — Do Not Sell. CE does not sell personal information. California residents also have the right to know what categories of personal information we collect, the right to delete, and the right to non-discrimination for exercising these rights.
How to exercise rights. Email containedevolution@gmail.com with "Privacy Rights Request" in the subject line. We will respond within 30 days (45 days for complex requests).
Legal basis for processing (GDPR): Contract performance (to provide the service you signed up for); Legitimate interests (security, fraud prevention, service improvement); Consent (Memory Bank sensitive data); Legal obligation (tax/billing records).
Data transfers. CE operates from the United States. By using CE from the EEA or UK, you acknowledge that your data is transferred to and processed in the US, a jurisdiction that may not offer equivalent data protection to your home country. We rely on Standard Contractual Clauses where required.

11. Background Automation & Scheduled Tasks

CE runs automated background processes on your behalf. By using CE you consent to these tasks operating on your account data:

Daily Brief. Each morning, CE generates a personalized daily summary using your data (tasks, journal, memory, calendar if connected). This task runs on CE-funded AI on your behalf (or your Stardust, if you have PASS).
Memory maintenance. Periodic background jobs summarize, prune, and consolidate your Memory Bank entries to improve quality and manage storage.
AI model maintenance (Orion). A background process periodically updates your Star's personality configuration based on ongoing interaction patterns.
Subscription processing. Automated billing and Stardust grants occur at the start of each billing cycle via Stripe webhooks.

These tasks consume CE-funded AI (the free floor) or, for PASS members, your Stardust balance. They do not take actions on external systems without your explicit setup (e.g., sending emails, posting to social media) unless you have specifically enabled such integrations.

12. Prohibited Uses & Acceptable Use

You agree not to use CE to:

Generate, distribute, or store content that is illegal, obscene, defamatory, harassing, or that violates any third party's rights.
Produce content that constitutes CSAM (child sexual abuse material) or that sexualizes minors in any way.
Attempt to jailbreak, manipulate, or circumvent the AI model's safety guidelines.
Use the service to automate spam, phishing, or social engineering attacks.
Attempt to gain unauthorized access to other user accounts or CE's systems.
Reverse-engineer, decompile, or extract CE's proprietary software, prompts, or AI configurations.
Use CE in a way that could damage, disable, or impair the service or burden infrastructure disproportionately.
Violate any applicable local, state, national, or international law or regulation.
Misrepresent your identity or impersonate CE or its personnel.

CE may suspend or terminate accounts that violate this policy without advance notice.

13. Third-Party Integrations

CE integrates with or links to third-party services. These integrations are provided for convenience; CE is not responsible for third-party services' practices, availability, or content.

Mapping. Map-It uses Google Maps APIs. Your use is also subject to Google's Terms of Service and Privacy Policy.
Taste Buds grocery handoff. If you enable grocery list handoff in Reactor and confirm the action in Taste Buds, CE sends the unchecked canonical item names and quantities on that shopping list to Instacart to create a hosted shopping-list page. CE does not place an order, choose products, or submit payment; you review and check out on Instacart under its own terms and privacy policy. The generated link is cached by CE for up to seven days while your list is unchanged.
DoorDash and Uber Eats handoffs. These buttons copy the unchecked list on your device for reference and open the selected external service. CE does not create a cart or place an order with those services.
External links. The app may contain links to external websites. Clicking a link takes you off CE; those sites' own terms apply.
Third-party APIs (BYOK). See Section 7.

If a third-party integration ceases to be available or changes its terms, CE may discontinue that integration without notice.

14. Disclaimers of Warranties

The service is provided "as is" and "as available" without warranty of any kind, express or implied. Contained Evolution LLC expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. CE does not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. CE does not warrant that AI-generated content will be accurate, complete, or appropriate for your purposes.

Some jurisdictions do not allow exclusion of implied warranties. In those jurisdictions, the above exclusions apply to the extent permitted by law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Contained Evolution LLC, its owner, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of or inability to use the service — including but not limited to loss of data, loss of profits, loss of goodwill, personal injury, or property damage — even if CE has been advised of the possibility of such damages.

In no event shall CE's total cumulative liability to you for all claims arising from or related to these terms or the service exceed the greater of: (a) the total amount you paid CE in the twelve months preceding the claim, or (b) $50 USD.

Some jurisdictions do not allow limitation of liability for certain types of damages. In those jurisdictions, liability is limited to the fullest extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless Contained Evolution LLC and its owner, officers, agents, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service in violation of these Terms; (b) your User Content; (c) your violation of any applicable law or third-party rights; or (d) any BYOK API key usage under your account.

17. Termination & Account Suspension

By you. You may close your account at any time through Account settings. Upon closure, your personal data is deleted within 30 days (except data required to be retained by law). Paid subscriptions are cancelled; no refund is issued for unused time beyond 7 days from the last billing date.

By CE. CE may suspend or terminate your account with or without notice if you violate these Terms, misuse the service, or if CE discontinues the service. We will attempt to provide advance notice of service discontinuation.

Effect of termination. Upon termination, your right to access the service ends. Sections of these Terms that by their nature should survive termination (including Sections 8, 14, 15, 16, and 18) will remain in effect.

18. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles.

Informal resolution first. Before filing a formal claim, contact CE at containedevolution@gmail.com and give us 30 days to attempt to resolve the dispute informally.

Binding arbitration. If informal resolution fails, any dispute arising from or related to these Terms or the service shall be resolved by binding individual arbitration administered by a mutually agreed arbitration service under its consumer arbitration rules. YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. This arbitration clause does not apply to claims for injunctive relief for IP infringement.

Small claims. Either party may bring eligible claims in small claims court instead of arbitration.

Venue. For any matter not subject to arbitration, you consent to exclusive jurisdiction and venue in the state or federal courts located in Michigan, USA.

19. Changes to These Terms

CE may update these Terms from time to time. When we make a material change:

We update the version stamp at the top of this page.
We display an in-app notification requiring you to review and agree to the new Terms before continuing.
For material changes affecting paid subscription terms, we will notify you at least 14 days in advance by email.

Continued use of CE after the effective date of updated Terms constitutes acceptance. If you do not agree, you must stop using the service and may cancel your subscription per Section 3.
